This Privacy Policy for Forte Nexus, Inc. and its parents, subsidiaries, affiliates, agents, representatives, consultants, employees, officers, and directors (collectively, “Forte”, “we”, or “us”) is intended to inform you about how we treat all the information that we receive and process about you (“Your Information”).
This Privacy Policy incorporates our Terms of Use and many of the definitions in it.
If you do not agree to any part of this Privacy Policy or our Terms of Use, then you may not use the Service.

Required disclosures
Though we make every effort to preserve member privacy, we may need to disclose your Private Information when required by law or if we have a good-faith belief that action is necessary to (a) comply with a current judicial proceeding, a court order, or legal process served on our website, (b) enforce this Privacy Policy or the Terms of Use, (c) respond to claims that your Private Information violates the rights of third parties, or (d) protect the rights, property, or personal safety of Forte, its members, and the public. You authorize us to disclose any information about you to law enforcement or other government officials as we, in our sole discretion, believe necessary or appropriate, in connection with an investigation of fraud, intellectual property infringements, or other activity that is illegal or may expose us or you to legal liability.
Removal
Upon your request, we’ll deactivate your account and remove Your Information from our active databases. Upon our receipt of your request, we will deactivate your account and remove your Private Information as soon as reasonably possible in accordance with our deactivation policy and applicable law. We will retain in our files information you may have requested us to remove if, in our discretion, retention of the information is necessary to resolve disputes, troubleshoot problems, or enforce the Terms of Use. Also, your information is never completely removed from our databases because of technical and legal constraints (for example, we will not remove your information from our backup storage).
We want to communicate with you only if you want to hear from us. We try to keep emails to a minimum and give you the ability to opt out of any marketing communications we send.
We may send you service-related announcements on the rare occasions when it is necessary to do so.
General
To modify or delete Your Information, please log in and update your profile. We may retain certain information as required by law or for necessary business purposes.
On request, we will give you a copy of all the personal information about you that we hold. This information request is subject to a fee not exceeding the prescribed fee permitted by law.
People under 18 (or the legal age in your jurisdiction) are not permitted to use Forte on their own, and so this privacy policy makes no provision for their use of Forte.
Information that you submit through the Services may be transferred to countries other than where you reside. We will protect all information we receive in accordance with this privacy policy.

By accessing or using the website goforte.fit or (the “Site”) and/or any services, features, content or applications offered by Echelon Forte, LLC. (“Elevate”, “we”, “us” or “our”), you (“you”, “your” or “User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Site or Services.
1. Definitions
“Services” means the Site, any mobile or desktop application, membership subscriptions, digital content, classes, and any other features made available by Elevate.
“Content” means all text, images, video, audio, graphics, and other information made available through the Services.
“Account” means a registered user account you create to access certain Services.
2. Eligibility & Account Registration
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services or have parental/legal guardian consent. When you register, you must provide accurate, current and complete information and maintain and promptly update your information. You are responsible for all activity through your Account, and must keep your password secure and confidential.
3. Subscription, Payments & Billing
If you purchase a subscription or pay for Services, you agree to the payment terms and fees indicated at purchase. Payments will be processed through our designated payment processor. You authorize us to charge your chosen payment method and to store the method information. Subscription renewals will occur automatically, unless cancelled prior to the renewal date. You are responsible for any applicable taxes. We may modify pricing or fees, but if materially changed, we will give you advance notice.
4. Use of Services & Prohibited Conduct
You agree to use the Services only for lawful purposes and in accordance with these Terms. Prohibited conduct includes, but is not limited to:
Violating any applicable law or regulation;
Infringing intellectual property or privacy rights;
Uploading harmful or malicious code;
Harassing other Users;
Scraping data from the Site;
Using the Services in a manner that could damage or impair our infrastructure.
5. Intellectual Property
All Content and Technology associated with the Services are owned by Elevate or its licensors. Except as expressly permitted in writing, you may not reproduce, distribute, adapt, create derivative works, publicly display or otherwise use any portion of the Services. If you submit Feedback, you assign to us all rights necessary to use and exploit the Feedback worldwide and perpetually.

The Services may contain links or integrations with third-party websites, applications or services. These are provided for your convenience only. We do not control and are not responsible for the content, accuracy, or practices of third parties. Your use of any third-party service is at your own risk.
7. Disclaimers & No Warranty
THE SERVICES ARE PROVIDED “AS-IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. Elevate DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, NOR THAT RESULTS WILL MEET YOUR EXPECTATIONS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, Elevate DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Elevate (OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR LICENSORS) BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SERVICES. Elevate’S AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, FOR ACCESS TO THE SERVICES IN THE TWELVE MONTHS PRIOR TO THE CLAIM.
9. Termination
We may suspend or terminate your access to the Services at any time, with or without cause or notice (unless prohibited by law). Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive (e.g., Intellectual Property, Disclaimers, Limitation of Liability, Governing Law) shall survive such termination.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or update these Terms at any time. If we make material changes, we will notify you by posting the updated Terms and updating the “Last updated” date. Your continued use of the Services after such notice constitutes your acceptance of the amended Terms. If you disagree, you must stop using the Services.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee. Any dispute related in any way to these Terms or the Services shall be resolved by binding arbitration in Chattanooga, Tennessee under the rules of Judicial Arbitration & Mediation Services, Inc. (“JAMS”), unless you opt out in writing within thirty (30) days of accepting these Terms. The decision of the arbitrator will be final and binding. To the fullest extent permitted by law, you and Elevate each waive the right to a trial by jury or to participate in a class action. If arbitration is found to be unenforceable, any disputes shall be submitted to the state or federal courts located in Hamilton County, Tennessee.
12. Indemnification
You agree to indemnify, defend and hold harmless Elevate and its affiliates, officers, directors, employees, agents, licensors and suppliers from any third-party claim, liability, damages, losses, costs or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or your use of the Services in breach of these Terms.
13. Severability
If any provision of these Terms is held invalid or unenforceable, the remainder of the Terms shall continue in full force and effect. The invalid/unenforceable provision shall be deemed modified to the minimum extent required to render it enforceable.
14. Entire Agreement
These Terms constitute the entire agreement between you and Elevate regarding your use of the Services, superseding all prior or contemporaneous communications, proposals or agreements, whether oral or written, between you and Elevate. Any waiver of any provision will be effective only if in writing and signed by Elevate.
